1. Acceptance of Terms

By accessing or using the Omniasis Cardiac Rehabilitation Platform ("Platform"), including the mobile application, admin portal, and hospital portal, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

Omniasis provides a remote cardiac rehabilitation monitoring platform that enables patients to perform guided exercises at home while their vital signs and exercise form are monitored by their healthcare team. The Platform includes:

  • Patient mobile application for exercise guidance and vitals tracking
  • Hospital portal for clinical staff to monitor patients
  • Administrative portal for platform management
  • Real-time alert system for critical health events
  • Integration with wearable health devices

3. Medical Disclaimer

The Omniasis Platform is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information provided by the Platform.

In case of a medical emergency, call 911 or your local emergency number immediately. The Platform's alert system is designed to supplement, not replace, emergency medical services.

4. Eligibility and Access

  • Patient access requires an access code provided by a participating healthcare facility.
  • Hospital portal access is limited to authorized clinical staff at participating hospitals.
  • Administrative access is limited to authorized Omniasis personnel.
  • You must be at least 18 years of age to use the Platform.
  • You are responsible for maintaining the confidentiality of your login credentials.

5. User Responsibilities

As a user of the Platform, you agree to:

  • Provide accurate and complete information
  • Follow exercise instructions and safety guidelines provided by the Platform
  • Stop exercising immediately if you experience chest pain, severe dizziness, difficulty breathing, or other concerning symptoms
  • Keep your account credentials secure and not share them with others
  • Notify your healthcare provider of any changes in your health condition
  • Not attempt to access data belonging to other patients or organizations
  • Not reverse engineer, decompile, or disassemble any part of the Platform

6. Healthcare Provider Responsibilities

Healthcare providers using the Platform agree to:

  • Use the Platform in accordance with applicable medical standards of care
  • Respond appropriately to alerts and notifications generated by the Platform
  • Maintain the confidentiality of patient data accessed through the Platform
  • Comply with all applicable HIPAA regulations
  • Ensure that only authorized staff members access the hospital portal
  • Report any suspected security incidents or unauthorized access immediately

7. Intellectual Property

The Platform, including its algorithms for exercise form assessment, cardiac safety monitoring, and multi-modal vital sign correlation, is protected by intellectual property laws. Patent pending. All content, features, and functionality are owned by Omniasis, Inc. and are protected by copyright, trademark, and other intellectual property laws.

8. Data Ownership

Patients retain ownership of their personal health information. By using the Platform, patients grant Omniasis a license to collect, process, store, and transmit their health data for the purpose of providing cardiac rehabilitation services and as described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Omniasis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or death, arising from your use of or inability to use the Platform. The Platform is designed to support, not replace, clinical decision-making by qualified healthcare professionals.

10. Service Availability

We strive to maintain Platform availability but do not guarantee uninterrupted access. We may temporarily suspend the Platform for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

11. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Data retention following termination is governed by our Privacy Policy and applicable law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State in which Omniasis is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the appropriate courts of that jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
